Section 7
Workers' Compensation
All Earlham employees are covered by Workers' Compensation
insurance for all injuries while at work. Earlham endeavors to
provide safe and healthful conditions in which to work. In addition
to obtaining prompt medical attention, details of any job-related
injury must be reported to the Business Office as soon as possible,
both for Worker's Compensation purposes as well as the record keeping
requirements of the Occupational Safety and Health Act. If an employee
is injured in the course of his/her work, the employee is eligible
for lost-wage compensation and medical expenses as determined by
the Workers' Compensation Law. Prior to returning to work, the
employee must submit a physician's
statement certifying the employee's ability to return to work and
perform all his/her duties.
Earlham reserves the right to require drug-testing
of employees involved in any accident which results in lost time,
injury
to self or others, or property damage.
In the event that an employee is disabled and receiving
Workman's Compensation Benefits, Earlham will continue to pay the
employer
portion of the employee's
group health insurance premium and the life insurance premium. While receiving
Workers Compensation benefits, all de minimus fringe benefits and Tuition Remission
at Earlham continue but only the health insurance and group life insurance paid
benefits are continued as described above.
Earlham will also bill employees who wish to extend
their dependent health care
coverage while receiving Workers’ Compensation benefits. If at any time,
the employee’s dependent coverage premium payments are more than 30 days
past due, Earlham’s health care coverage will cease and COBRA coverage
will be extended to the dependent. In the event that the employee is no longer
eligible for workers compensation benefits and does not return to employment
at Earlham, then health care coverage will continue at the employee’s expense
under COBRA. The employee must contact the Business Office to make arrangements
for these billing procedures.
