If you haven't yet sent in a comment on the EC report and its OA recommendations, it's not too late. The deadline has passed, but the sponsors will still accept comments.
Send your comment to rtd-scientific-publication@cec.eu.int. Even a short comment in support of recommendation A1 would be better than no comment at all. The door may not be open much longer.
